Thanks to intervention by the
International Academy of Compounding Pharmacists,
pharmacists who received the subpoena duces tecum
(SDT) described in the recent Pharm
Phlash do NOT
have to respond to the subpoena and should receive
a withdrawal notification shortly. IACP will be
filing an amicus brief as an alternative to the
subpoenas.
An
amicus curiae
brief refers to a situation in which someone who
is not a party to a case offers information on a
point of law or some other aspect of the case to
assist the court in deciding a matter. This
particular brief from IACP will articulate to the
court the legal basis for pharmacy compounding,
the current standards of practice, regulatory
oversight and the role of the Food and Drug
Administration in regard to compounding. The brief
will not offer any opinion or defense in regard to
the allegations against the defendants.
